Utah Bicycle DUI

About Utah Bicycle DUI LawsAlthough most DUI cases involve cars, trucks, SUVs and motorcycles, there are rare cases involving bicycle DUIs in Utah. There is considerable confusion with Utah’s driving while impaired laws, whether or not they pertain to cyclists and what “vehicles” are subject to the law.

Can You Be Charged With a Bicycle DUI in Utah?

Although cyclists must obey traffic laws, it is highly unlikely that operators of bicycles can be charged with a D.U.I.  According to U.C.A. § 41-6a-1102, a person operating a nonmotorized bicycle or a vehicle or device propelled by human power is not subject to the penalties related to operator licenses under alcohol and drug-related traffic offenses. However, riding your bicycle while you are intoxicated could result in harm to yourself or others. Remember, cyclists can still be charged with other criminal conduct including public intoxication.
